Obiettivi formativi

 

Gli obiettivi del'insegnamento mirano a far acquisire conoscenze specifiche in merito all'ordinamento giuridico della Chiesa cattolica che ha avuto una influenza rilevante nella formazione della civiltà giuridica occidentale e tuttora svolge un ruolo fondamentale nella vita delle popolazioni di area a maggioranza cristiana. Si intende, inoltre, far acquisire la capacità di comprendere il modo in cui l'ordinamento ecclesiale ha preso coscienza della peculiarità dei propri principi ispiratori e si è evoluto per rispondere alle esigenze specifiche delle comunità cristiane nel corso della storia, assumendo una conformazione tipica che lo caratterizza rispetto agli altri ordinamenti giuridici, sia quelli statali che quelli religiosi. Infine, si vuole trasmettere la capacità di valutare criticamente la rispondenza dell'ordinamento canonico alle sfide del mondo contemporaneo, come cioè abbia saputo adeguare le proprie norme e i propri istituti al progresso culturale e scientifico dell'epoca attuale

 

 

The purposes of the teaching are to acquire specific knowledge about the legal system of the Catholic Church, which has had a significant influence on the formation of Western legal civilization and still plays a fundamental role in the life of the majority Christian populations. It is also intended to help students acquire the ability to understand the way in which the ecclesial order has become aware of the peculiarity of its inspiring principles and has evolved to meet the specific needs of Christian communities throughout history, assuming a typical conformation that characterizes it with respect to other legal systems, both state and religious. Finally, the aim is to transmit the ability to critically evaluate the canonical order's conformity to the challenges of the contemporary world, that is, how it has been able to adapt its norms and institutes to the cultural and scientific progress of the present age.

Al termine dell'insegnamento la studentessa / lo studente sarà in grado:

- di conoscere e di comprendere i principi fondamentali, gli istituti e le regole essenziali dell'ordinamento canonico;

- di comprendere i profili essenziali di comparazione tra l'ordinamento della Chiesa e gli altri sistemi giuridici, sia statali che religiosi, tanto nell'evoluzione storica quanto nella normativa attuale;

- di esprimere giudizi autonomi circa la compatibilità degli attuali sviluppi del progresso culturale e scientifico con i principi e le norme della tradizione canonistica, nonché di  valutare criticamente le possibilità di adeguamento dell'ordinamento canonico alle sfide del mondo contemporaneo.

 

 

At the end of the teaching students will be able:


- to know and understand the fundamental principles, institutes and essential rules of the canonical order;


- to understand the essential profiles of comparison between the Church's system and other juridical systems, both state and religious, both in historical evolution and in current legislation;


- to express autonomous judgements about the compatibility of current developments in cultural and scientific progress with the principles and norms of the canonistic tradition, and to evaluate critically the possibilities of adapting the canonical order to the challenges of the contemporary world.

Programma

 

36 ore di lezione, 6 CFU

Il corso intende presentare l'evoluzione della tradizione giuridica dell'ordinamento canonico nel corso della storia, l'interazione tra ius canonicumius civile nella formazione della civiltà giuridica occidentale e, nella prospettiva dell'attualità, la tipicità del sistema giuridico ecclesiale rispetto agli altri sistemi giuridici, statali o religiosi, e le soluzioni peculiari date alle sfide del mondo contemporaneo.

Il programma prevede anzitutto la trattazione degli elementi fondamentali dell'ordinamento della Chiesa, vale a dire le fonti giuridiche e le strutture costitutive dell'istituzione ecclesiale.

Di seguito sono approfonditi alcuni argomenti specifici di particolare rilievo:

- equità e amministrazione della giustizia;

- i rapporti tra ordinamento canonico e altri ordinamenti giuridici statali  e religiosi;

- le relazioni chierici-laici e uomini-donne nell'ambito dell'ordinamento ecclesiale.

Ogni tematica, sia quelle introduttive che quelle di approfondimento, sono esaminate prima sotto il profilo dell'evoluzione storica e poi nel sistema attuale.

 

 

The course aims to present the evolution of the juridical tradition of the canonical order throughout history, the interaction between ius canonicum and ius civile in the formation of Western juridical civilization and, from the perspective of current events, the typicality of the ecclesial juridical system compared to other juridical, state or religious systems, and the peculiar solutions given to the challenges of the contemporary world.
The programme provides above all for the treatment of the fundamental elements of the Church's system, that is, the juridical sources and the constitutive structures of the ecclesial institution.
Below are some specific topics of particular importance:
- equity and the administration of justice;
- the relations between the canonical system and other state and religious juridical systems;
- relations between clergy-laity and men-women within the ecclesial order.
Each topic, both introductory and in-depth, is examined first from the point of view of historical evolution and then in the current system.

Modalità di verifica dell'apprendimento

L'esame si svolgerà, per tutti, in forma orale mediante un colloquio con i docenti in cui il/la candidato/a dovrà dimostrare di possedere le nozioni fondamentali oggetto dell'insegnamento e di aver sviluppato un linguaggio idoneo e la capacità di rielaborare in forma critica i contenuti dell'insegnamento. Il voto finale sarà espresso in trentesimi.

Per gli studenti che frequentano le lezioni:

A coloro che intendono frequentare le lezioni viene offerta la possibilità di svolgere un lavoro personale di rielaborazione critica su un tema concordato con i docenti inerente agli argomenti sviluppati nel corso. Il lavoro deve essere ampio tra i 30.000 e i 40.000 caratteri (spazi inclusi, corrispondenti a  10 - 15 pagine) e deve essere consegnato ai docenti per mezzo della posta elettronica, almeno 10 giorni prima della data del primo appello utile.

In sede di appello orale lo/a studente/ssa sosterrà il colloquio sulla base dei testi consigliati e degli appunti presi a lezione.

La valutazione finale sarà costituita dalla media tra il voto della relazione scritta e quello della prova orale e sarà espresso in trentesimi.

 

Per gli/le Studenti/sse che non frequentano le lezioni

L'esame si svolgerà sulla base del solo colloquio orale e avrà come programma i contenuti dei testi consigliati. Il voto sarà espresso in trentesimi.

 

The examination will take place, for all, in oral form by means of an interview with the lecturers, in which the candidate must demonstrate that he/she has mastered the fundamental notions covered by the teaching and has developed a suitable language and the ability to critically review the teaching content. The final grade will be expressed in thirtieths.

 

For students attending lectures:

Those who intend to attend the lectures are offered the opportunity to carry out a personal work of critical reworking on a topic agreed with the lecturers related to the topics developed in the course. The work must be between 30,000 and 40,000 characters (including spaces, corresponding to 10 - 15 pages) and must be handed in to the lecturers by e-mail, at least 10 days before the date of the first useful appeal.

At the oral examination, the student will be interviewed on the basis of the recommended texts and lecture notes.

The final grade will be the average of the grade for the written paper and the oral test and will be expressed in thirtieths.

 

For students not attending lectures

The examination will be conducted on the basis of an oral interview only and will cover the contents of the recommended texts. The grade will be expressed in thirtieths.
